Terms of Service
These terms explain how SmartSites (“we”) works with the businesses we design websites for (“you”). By paying for a plan, you agree to them. If anything is unclear, email us at hello@smartsitesco.com before you buy.
SmartSites is operated by Matt Smart, a sole proprietor in Owasso, Oklahoma.
1. What we provide
We design, host and look after a website for your business, based on the plan you choose:
- Upgrade, for businesses that already have a website: a new design based on your current site, the switch-over to it, and hosting. You keep your own web address and email.
- Launch, for businesses without a website: a personalized web address, one business email inbox, a site designed for you, and hosting.
Each plan includes the features listed on our prices page at the time you buy. Every business on the same plan pays the same published price.
2. Timing
We aim to send you a draft of your site within 48 hours of receiving your information and photos. “48 hours” is our goal, not a guarantee; waiting on your content, getting access to your web address settings, or unusual requests can extend it. Your site goes live once you approve the draft.
3. Your content and your responsibilities
- Accuracy. You are responsible for everything your site says about your business, including prices, hours, services and claims. Please review your site carefully before it goes live, and tell us when something changes.
- Photos and materials. You confirm you have permission to use every photo, logo and piece of text you give us, or that we use at your request, including material from your current website or social media pages.
- Reviews. We only show genuine customer reviews that you provide, copied word for word. We never write or edit reviews.
- Licenses and rules. You are responsible for following the laws and industry rules that apply to your business and its advertising.
- What we won’t publish. We may decline or remove content that is unlawful, misleading, defamatory or threatening, or that infringes someone else’s rights.
4. Updates
Your first year includes 3 updates, and each renewal year includes 4. One “update” is one round of changes sent to us together, such as new hours, prices, photos or text. Extra updates are $25 each. New pages, new features or a redesign aren’t updates and are quoted separately.
5. Payment
- Your first-year price covers everything in your plan for one year: $549 for Upgrade, or $649 for Launch. It’s paid in advance, before we start.
- Your plan renews automatically. After your first year, the card you paid with is charged each year on the anniversary of your order, until you cancel: $99 per year for Upgrade, or $129 per year for Launch, which includes renewing your web address and email inbox.
- We’ll email you at least 30 days before each renewal date.
- How to cancel. Email hello@smartsitesco.com or reply to any renewal email any time before your renewal date. Once you cancel you are not charged again, and your plan runs to the end of the year you have paid for.
- Upgrade add-ons. New Web Address + Email is $99 for the first year and adds $30 to each renewal, so your plan renews at $129 per year. Business Email is $50 per year per inbox.
- Extras. Some situations cost extra, such as moving your email off an old web host, additional inboxes, or a larger site. We’ll always tell you the price and get your agreement before you pay for any extra.
6. All sales are final
- All payments are final and non-refundable. We start on your site as soon as your order comes in. For Launch, that includes registering your web address and setting up your email inbox, and those purchases can’t be undone.
- Renewal payments and extras are also non-refundable. We email you at least 30 days before each renewal, and you can cancel any time before your renewal date so you’re never charged again.
7. Web addresses and email
Upgrade. Your web address and email stay yours. With your permission, we change only the settings needed to point your web address to your new site, and we don’t change your email settings. You remain responsible for renewing your web address with the company it’s registered with, and for cancelling your old website plan once we tell you it’s safe to do so. If you add Business Email, the inbox is provided through our email provider on your web address while your plan is active, and you’ll get time to save your messages if you leave.
Launch, and the New Web Address + Email add-on. We register your web address in our name and manage and renew it for you while your plan is active. When your plan ends, we let the address expire. We never sell, reuse or redirect an address that includes your business’s name. Your business email inbox is provided through our email provider for as long as your plan is active. If you leave, we’ll give you time to save your messages before the inbox is closed.
We never ask for your passwords. Where we need access to your web address settings, you invite us through your provider or make the changes yourself with our help.
8. Other services you use
If you use online booking, ordering, a store, or another service, we link to it from your site. Those services are run by other companies, and we’re not responsible for how they work or what they charge. We’ll help you set up or update your Google Business Profile, but Google owns it and requires you to verify it yourself.
9. When your year ends
We’ll email you at least 30 days before each renewal. You can:
- Keep your plan. You don’t need to do anything. Your card is charged automatically and everything keeps running just as it is.
- End your plan. Cancel before your renewal date. We send you a copy of your website files so you can host them anywhere. For Upgrade, your web address and email are already yours. For Launch, your web address expires and your email inbox closes, after we give you time to save your messages.
Nothing is ever taken down by surprise.
10. Contact form messages
Messages customers send through your site’s contact form belong to your business. We forward them to you and don’t sell them, share them or use them for anything else.
11. No guarantees about results
A website can help customers find and choose your business, but we can’t promise any particular search ranking, number of visitors, calls or sales.
12. Limitation of liability
We work hard to keep every site online and error-free, but websites occasionally have outages that are outside our control. To the extent the law allows, our total responsibility to you for any claim is limited to the amount you paid us in the 12 months before the claim.
13. Changes to these terms
We may update these terms from time to time. Changes won’t apply to a plan you’ve already paid for without your agreement.
Privacy Policy
What we collect
- When you contact us through our forms or by email: your name, business name, email, phone number, your current website or social media page, and anything you choose to tell us.
- When you become a customer: the information, photos and text you give us for your site, and billing details. Payments are handled by our payment processor; we never see or store your full card number.
- Public information: we may use publicly available information about businesses, such as their existing website, public business listings and public social media pages, to prepare a sample design and reach out about our services.
How we use it
Only to design and run your site, communicate with you, send invoices and improve our service. We never sell your information.
Sample designs
If we prepared a sample design for your business before you asked us to, it is private, marked as a draft, and hidden from search engines. Ask us and we’ll take it down right away.
Emails from us
If we contact you about our services and you’d rather not hear from us, just reply “no thanks” or “unsubscribe”, and we won’t contact you again.
Who else handles data
We use trusted service providers to run the business: website hosting and form handling (Netlify), payments (our payment processor), web address registration and email. They only use your information to provide those services.
Your choices
You can ask us to see, correct or delete the information we hold about you at any time by emailing hello@smartsitesco.com.
